Terms of Service
1. Acceptance
By creating an account or using Phantom OS products (Phantom Crew, Phantom Cards, Phantom Admin Clerk, and any future products in the suite), you agree to these terms. If you are signing up on behalf of a funeral home, you represent that you are authorized to bind that funeral home to these terms.
2. Service
Phantom OS provides software-as-a-service to licensed funeral homes for staffing coordination, memorial card generation, and (when launched) administrative paperwork automation. Specific features available to your account depend on the products you have subscribed to.
3. Subscription and payment
Subscriptions are billed monthly or annually as selected. Founding Member pricing, if granted, is locked at the rate quoted at the time of signup and remains in effect as long as the subscription stays active without interruption. Cancellation takes effect at the end of the current billing period.
4. SMS use and consent
Phantom Crew sends SMS to funeral home staff (casket bearers, drivers, clergy, dressmen, livery vendors) to ask them to work specific services. Phantom Crew SMS is transactional and operational only — no marketing, no promotions, no broadcast.
SMS consent: when a funeral home adds a staff member, Phantom Crew sends a one-time consent-request SMS. The staff member must reply YES to confirm. Only after that explicit reply is consent recorded and service-assignment SMS allowed.
Message frequency: typically 2–5 messages per week, only when the staff member is being asked to work a service. Msg & data rates may apply.

Customers (funeral homes) agree to add staff to their roster only when those staff have a pre-existing employment or contractor relationship with the funeral home, and agree not to use Phantom Crew to send marketing, promotional, or unsolicited messages.
5. Data ownership
Funeral homes retain ownership of all data they enter into Phantom OS — decedent records, staff rosters, family contacts, etc. Phantom OS uses this data solely to provide the service.
6. Limitation of liability
Phantom OS is provided "as is" without warranty of any kind. To the maximum extent permitted by law, Phantom OS LLC is not liable for any indirect, incidental, or consequential damages arising from use of the service. Direct liability is capped at the amount the customer has paid in the trailing 12 months.
